Underground Injection Control Program Update
August 13, 2008

The Fort Peck Tribes application for program primacy to regulate underground injection control activities under the Safe Drinking Water Act is being review at the US EPA Washington D.C. Headquarters Office. All public notification has been completed and EPA has prepared a responsiveness summary to the comments received from the public. Until the program is approved, the Office of Environmental Protection is conducting inspections on behalf of EPA under a Direct Implementation Cooperative Agreement (DITCA) with EPA.

If the program is approved by EPA, there will be a phased transition process for the regulatory program. Therefore, all current and potential permit holders or applicants are asked to continue to work directly with EPA and submit any permit applications to EPA as permit applications will also be part of this phased transition process. Permitting by the tribal program may be delayed while other aspects of the program, such as financial responsibility, are implemented.
